Privacy Policy

1. Introduction

Protecting your privacy matters to us. This policy explains what personal data we collect when you visit smellofclassics.com, how we use it, and your rights. Processing is governed by the revised Swiss Data Protection Act (revFADP/revDSG) and, for visitors and customers in the EU/EEA, by the GDPR.

As a Swiss company that occasionally serves customers in the EU/EEA, we are not required to appoint an EU representative under Art. 27(2) GDPR (occasional processing, no large-scale or special-category data).

3. Data security

Our website uses SSL/TLS encryption to protect data you transmit to us. An encrypted connection is shown by "https://" in the browser address bar.

4. Server log files

Each time the site is accessed, general data is stored automatically in server log files: browser type/version, operating system, referrer, date and time of access, and IP address. This data is needed to deliver content correctly, ensure security, and optimise the site. It is not merged with other sources for profiling and is generally deleted after 90 days. Legal basis: our legitimate interest in a secure, functioning website (Art. 31(1) revFADP / Art. 6(1)(f) GDPR).

We collect only what is needed for these purposes and do not sell personal data. Where processing is based on consent, you may withdraw it at any time with effect for the future — for the newsletter, via the unsubscribe link in every email.

6. Third-party services & transfer abroad

  • Squarespace (Squarespace Inc., USA) — website hosting, forms, and site analytics

  • Google Analytics (Google LLC, USA) — website usage statistics; analytics cookies are set only after you consent via our cookie banner (see Section 7)

  • Stripe / Squarespace Payments / PayPal — payment processing (data shared only as needed to complete payment)

  • Weglot (Weglot SAS, France) — website translation

  • Elfsight (Elfsight, Cyprus) — embedded content widgets (e.g. WhatsApp button)

  • Meta (Instagram/Facebook) — only where you interact with our social links

Some providers process data outside Switzerland/the EU, including the USA. Such transfers rely on Standard Contractual Clauses and/or the Swiss–US and EU–US Data Privacy Framework, ensuring an adequate level of protection.

7. Cookies and consent

We use cookies that are strictly necessary for core functionality (cart, checkout) — these do not require consent. Any analytics, marketing, or third-party tracking cookies (including Google Analytics) are set only after you give consent through our cookie banner, and never before. You can change or withdraw your choice at any time via the banner or your browser settings. Legal basis: consent (Art. 6(1)(a) GDPR); necessary cookies rely on legitimate interest.

8. Retention

We keep personal data only as long as necessary for the stated purpose. Accounting and transaction records are retained as required by Swiss commercial and tax law (generally 10 years, Art. 958f CO); enquiry and newsletter data are deleted once no longer needed or on withdrawal of consent.

9. Your rights

You may request access, rectification, erasure, restriction, or portability of your data, object to processing, and withdraw any consent, in writing to info@smellofclassics.com. Swiss residents may contact the Federal Data Protection and Information Commissioner (FDPIC, www.edoeb.admin.ch); EU/EEA residents may lodge a complaint with their local supervisory authority. We do not carry out automated decision-making or profiling.

We may update this policy in line with legal or operational changes; the current version always applies.
