Allgemeine Geschäftsbedingungen für Fahrten

Status: October 2026

These Terms & Conditions govern participation in the car events organised by Smell of Classics GmbH. By registering or completing a booking, you confirm that you have read, understood and accepted them. "Participant" means every person named in a booking, including co-drivers and passengers.

1. Organiser

Smell of Classics GmbH, Sinserstrasse 67, 6330 Cham, Switzerland (UID: CHE-200.647.740), referred to as "the organiser", "we" or "us". Event contact: Maurycy Mioduski, maurycy.mioduski@smellofclassics.com, +41 79 103 00 19.

2. The event

We organise car-focused events, including multi-day, self-driven driving tours that combine driving with culinary and cultural experiences. The route, dates, programme, number of places and what is included are described on the booking page of each event.

3. Booking terms

3.1 Booking and payment
A place is confirmed only once the full price has been received. Where a booking is made through our website, payment is taken at checkout. Where a separate registration form is used, the fee must be paid within the period stated at registration, and failure to pay within that period may lead to the cancellation of the registration. Bookings are personal to the named participants, and places are limited and allocated in the order in which full payment is received. All prices are quoted in Swiss francs (CHF). We are not registered for Swiss VAT, so prices are quoted without VAT.

3.2 Price, included and excluded

The price of each event and what it includes are stated on its booking page. Unless stated otherwise there, the price does not include:
- fuel, road tolls, vignettes and parking fees;
- lunches, drinks and any meals not listed as included;
- travel to the start point and back home from the finish;
- vehicle insurance, roadside assistance, recovery and any repair or mechanical costs;
- personal expenses of any kind.

3.3 Transfer of your place
A place may be transferred to another person only with our prior written consent. The new participant must meet the requirements in section 5 and accept these Terms & Conditions before the transfer is confirmed. We may decline a transfer, in particular where the new participant or vehicle does not meet these terms or where the organisation of the event does not allow it. Any additional costs arising from a transfer, such as changes to hotel bookings, are borne by the participant. Any payment between the original and the new participant is a matter between them alone. Until we have confirmed the transfer in writing, the original participant remains responsible for the booking.

3.4 If you cannot attend
Once confirmed, a booking cannot be cancelled by the participant and the amount paid is non-refundable. This also applies if you arrive late, leave the event early or do not take part in parts of the programme. If you know that you cannot attend, please let us know as soon as possible. We will look at each case individually, and any goodwill gesture we may offer is at our sole discretion and does not create a right to a refund in that or any other case.

3.5 No right of withdrawal

Under Article 16(l) of Directive 2011/83/EU, the statutory right of withdrawal does not apply to contracts for leisure services provided on a specific date or during a specific period. As each event is tied to specific dates, participants who are consumers in the EU or EEA have no right of withdrawal once a booking is made. Section 3.4 applies instead.

4. Changes or cancellation by the organiser

4.1 We may cancel an event if the minimum number of participants required for it is not reached, or for reasons of force majeure, meaning events beyond our reasonable control such as natural disasters, severe weather, pandemics, road closures or governmental restrictions. If we cancel for these reasons, you will be offered a place on a rescheduled event or a full refund of the amount paid.

4.2 Our events take place in all weather conditions. We postpone an event or shorten a route only for genuine safety reasons, such as heavy snow or road closures, and we will inform participants as early as possible.

4.3 We may make reasonable changes to the route, timings, accommodation or programme where necessary, and we will communicate material changes as early as possible. Reasonable changes do not entitle participants to a refund.

4.4
Beyond the refund described in section 4.1, we are not liable for any other costs arising from a cancellation or change, such as travel, fuel or accommodation booked by the participant.

5. Participants and vehicles

Each participant must, for the full duration of the event:
- be at least 18 years old and hold a valid driving licence, with at least one licensed driver per vehicle;
- bring a roadworthy, road-legal vehicle that is properly registered and suitable for the event;
keep the vehicle in good working condition before and throughout the event.

Our events are driven together as a group, so each vehicle must be able to keep up with the group on the route described. The participant is responsible for the condition and legal compliance of their vehicle at all times. We may refuse to admit a vehicle that we reasonably consider unsafe or unsuitable for the route, in which case section 3.4 applies.

6. Safety and conduct

Our events are not races. Participants must drive safely, responsibly and in compliance with all applicable traffic laws. Driving under the influence of alcohol or drugs is strictly prohibited. Participants must behave respectfully towards other participants, staff and the public. We may exclude any participant without refund who drives dangerously, is under the influence of alcohol or drugs, or seriously breaches traffic law or these terms.

7. Insurance and breakdown

7.1 Participants must hold valid and adequate insurance covering their vehicle and personal liability for all countries on the route, including, where required, an International Insurance Card (Green Card). Proof of insurance must be provided on request.

7.2 Roadside assistance, recovery, towing and repairs are the responsibility of the participant, who should carry suitable roadside assistance cover for all countries on the route. If a vehicle breaks down, we will help where we reasonably can, although the group may continue the route according to the programme. Any additional costs arising from a breakdown, including travel, accommodation and repairs, are borne by the participant.

8. Assumption of risk and liability

Participants acknowledge that driving involves inherent risks, including traffic accidents and adverse weather, and take part at their own risk. Our liability is limited to the extent permitted by Article 100 of the Swiss Code of Obligations (CO). In particular:
- we are liable for damage caused by our gross negligence or wilful misconduct, and this liability is not excluded;
- to the extent permitted by law, we exclude liability for slight negligence and for indirect or consequential loss;
- we are not liable for damage, injury, loss or accidents arising from a participant's own driving, the condition of a participant's vehicle, or a participant's failure to comply with traffic law or these terms;
- mandatory liability for personal injury or death caused by fault is not excluded or limited.

You remain responsible for your own vehicle, passengers and conduct throughout the event.

9. Indemnity

Each participant is liable for damage or loss they cause to third parties, to suppliers or to the organiser through their own fault during the event, and shall hold the organiser harmless from third-party claims arising from such conduct. This does not extend to matters for which we are responsible under section 8.

10. Third-party suppliers

Some services, such as hotels and restaurants, are provided by independent third parties. We select these suppliers with due care but are not liable for their acts or omissions beyond any liability arising from our own negligent selection.

11. Media and image rights

We arrange professional photography and videography at our events. By participating, you agree that images and footage taken during the event, which may include you and your vehicle, belong to the organiser and its photographers, and that we may use them for our promotional and commercial purposes without further consent or payment. If you do not wish to appear, please inform the event contact in writing before the event.

12. Data protection

Personal data collected for a booking is processed in accordance with our Privacy Policy and applicable law, namely the Swiss revFADP and, where relevant, the GDPR.

13. Amendments, governing law and jurisdiction

13.1 We may amend these terms from time to time. The version accepted at the time of your booking applies to that booking, and amended terms apply to bookings made after the change. Where a material change to a booked event becomes necessary, section 4 applies.
